Terms and Conditions of Contract


  1. Purpose and scope of application

This contractual document governs the purchase of products and services through the website https://www.pleniage.com/ owned by Safivita S.L. By accepting this document the user declares that:

  • They have read, understood and accept the conditions set out herein.
  • They are of legal age or have the legal capacity to enter into a contract.
  • They accept and undertake to comply with all the conditions and obligations set out in this document.

Pleniage® is a registered trademark of Safivita S.L. (hereinafter, "the provider").

 

  1. General terms

All sales of products made by the provider are subject to these general terms and conditions of contract (hereinafter, GTC), unless expressly stipulated otherwise in writing. No other condition or agreement shall have any legal value or effect without the provider's express acceptance in writing.

These GTC exclusively govern the contracts made through https://www.pleniage.com.

The products and services are available for sale and delivery throughout the entire Spanish territory, including the Canary Islands and the Balearic Islands, as well as in Portugal. For shipments to other countries, please contact us beforehand at info@pleniage.com.

The prices of each product include Value Added Tax (VAT) and are expressed in euros (€), unless otherwise indicated.

The applicable prices are those published on the website and will be applied automatically in the last phase of the purchase process, including taxes and additional transport or service charges, which will be reported to the customer beforehand. The customer accepts that some prices may vary in real time; in any case, such variation will be communicated before completing the purchase.

 

Any payment made to the provider will entail the issuance of a confirmation email. The purchase receipt will be available in the customer account at https://www.pleniage.com. To request an official invoice, if it is not available in the customer area, contact us through info@pleniage.com.

Stock confirmation will be subject to validation by the provider. In the event of lack of stock, the customer may choose between receiving the product once available or requesting a refund. If the product cannot be replenished within an appropriate period, the amount paid will be refunded using the same payment method or any other agreed upon with the customer.

 

  1. Procedure for Placing an Order

The customer may place orders at any time through the website: https://www.pleniage.com

To do so, follow these steps:

  1. Access our store with your browser from a computer, tablet or smartphone through the URL: https://www.pleniage.com
  2. From the home page, if you have already registered, you can access your user account. If you have not done so yet, we invite you to register completely free of charge.
  3. Explore our products. Browse our categories to find specific products. Each item has a detailed description and photos so that you can see its characteristics.
  4. Click on the product you are interested in. Choose the number of units you wish to purchase, the purchase mode (one-time payment, or recurring payment) and then click on "Add to cart".
  5. When you have added all the products you want to buy, go to the cart icon in the upper right corner. Here you can see a summary of your items, modify quantities or remove products if necessary.
  6. Once your cart is ready, click on "Checkout". You will be directed to a secure page where you can enter the information needed for your purchase.
  7. Complete your shipping details, such as name, address and contact telephone number.
  8. Make sure that all the details are correct to avoid problems with delivery.
  9. Choose the payment method. We accept several secure forms of payment, including credit card, debit card, and other options (specify if you use PayPal, transfers, etc.). Select your payment method and complete the required details.
  10. Review and confirm your order
  11. Before finalising, verify that all the details are correct. Click on "Place order" to complete your purchase. You will receive a confirmation email with the details of your order, as well as shipping updates
  12. Once we process your order we will inform you and you will receive shipping updates.

 

  1. Shipping Options
  2. Recurring Shipment

For products that you need frequently, we offer automatic shipments every 2 weeks, 1 month, or 2 months, with competitive discounts. Simply choose the frequency on the product page, and you will receive your items automatically without needing to place a new order each time. You can cancel the recurring shipment at any time from your customer area.

 

  1. Normal Shipment

If you prefer to buy only when you need it, select normal shipment. You make a single payment and receive your order once. When you want to place another order, reconnect to https://www.pleniage.com

 


  1. Total price

The sale prices indicated in the catalogue and on the website are shown in euros and include VAT. The provider reserves the right to run exclusive promotions and to modify prices and offers on this channel.

 

  1. Shipping costs

Shipping costs will be added to the total amount of the selected products, broken down before finalising the order. There may be free shipping promotions depending on the purchase amount.

 

  1. Payment methods

We offer the following secure payment methods through the Shopify Payments gateway:

  • Credit/debit cards: Visa, Mastercard, American Express, Maestro or UnionPay.
  • Apple Pay, Google Pay, PayPal, Klarna (payments in 3 instalments interest-free, at 0% APR), and Shop Pay.

 

  1. Shipping provider

Products purchased from Safivita will be shipped to mainland Spain, the Balearic Islands and mainland Portugal applying the 24-hour service rate of SEUR. The provider reserves the right to replace the logistics provider for tactical reasons, in particular in the event of unavailability of the service at any of the destinations with the aforementioned provider and services.

 

  1. Handling, preparation and delivery of the shipment

The product preparation time for shipment will normally be less than 1 working day from the moment of purchase.

We keep detailed control of our inventory, but there is always the possibility of a lack of stock availability, in which case we will contact you to inform you and offer an alternative solution or a refund of the amount.

 

Delivery of the order

Under normal conditions, delivery will be made within 1 to 3 days from the date of order confirmation.  In the event of a delay caused exclusively by the transport company, the provider does not assume responsibility. From the moment we ship our products until delivery to the final recipient, the carrier will be responsible for any damage caused, exempting the provider from liability.

In the event of any incident in the shipment or that, for reasons beyond the control of the provider or the transport company, or due to force majeure, you do not receive the products within the indicated period, we invite you to consult us at info@pleniage.com

 

  1. RETURNS AND CANCELLATION POLICY

10.1 Types of return and cancellation.

The provider distinguishes three different cases for return and cancellation:

  1. Return due to incomplete or incorrect data. In the event that an order cannot be delivered due to lack of information in the delivery address and/or it being incorrect, the costs incurred by such return may be deducted from the amount to be refunded for the returned order.
  2. Cancellation. Once the order is confirmed, in general it will no longer be possible to modify or cancel it. In some cases, through our customer service department, provided that the product has not left our logistics facilities towards its destination, modifications or cancellations may be made, but we cannot guarantee this. In the event that the user wishes to cancel an order that has already been processed, the customer must bear the payment of the transport costs incurred by the cancellation.
  3. Returns due to withdrawal from purchase. All our products may be returned and refunded, provided that you notify us of your intention to return the product(s) within a period of 14 calendar days after receipt and that they comply with the rest of the conditions we establish in the section "Requirements for returns due to withdrawal from purchase".
  4. Returns due to defective products. In cases where you consider that, at the time of delivery of the product, it does not conform to what is stipulated in the contract or that it is defective or has suffered damage during shipment, you may claim it within a period of 48 hours after its receipt following the steps we define below:
    1. Photograph the product so that we can see the damage caused by transport and/or damage suffered by the product.
    2. Photographs of the packaging, both the exterior and interior parts and the shipping label. As well as the general condition in which the order was received. (Information required in order to claim against the carrier)
    3. Contact us to provide us with all the product details, through the return form
    4. When we receive the notification, we will get in touch to indicate the procedure to follow in each case.

 

 

10.2. Requirements for returns due to withdrawal from purchase.

To return the product, use the same box and protection with which you received the product. In the event that you do not have that box, you must return the product to us in a similar box, duly protected, so that the product arrives in good condition at our warehouses.

The products to be returned must be unused and unsealed and in the condition in which they were delivered, that is, with all their elements and accessories.

The amounts paid for the item(s) will be refunded. Under no circumstances will we accept returns sent carriage forward (with delivery charges payable on receipt).

Under no circumstances will we accept the return of products that have been used or unsealed after delivery.

We cannot accept returns if you do not notify us within a maximum period of 14 calendar days from the moment of receipt. The refund will always be made through the same payment method used by the customer or, failing that, by bank transfer. The costs of return will be borne by the consumer and/or user, even in the event that the product was purchased with a free shipping promotion.

Partial returns and/or cancellations will give rise to partial refunds of the amount paid for the order, but the transport costs cannot be refunded in the case of partial returns.

 

10.3. Procedure to follow to make returns due to withdrawal from purchase.

  • Contact us at info@pleniage.com to provide us with all the product details, through the return form.
  • Prepare the package for the return as indicated in the requirements section.
  • Upon receiving the products we will proceed to examine them and we will inform you whether or not you are entitled to the refund of the amounts paid for the products purchased, in which case we will proceed to refund you the amount of the returned product or products.
  • The return process will be carried out as soon as possible and, in any case, within the period of 14 days from the date on which we were notified of the intention to withdraw.
  • The refund will be carried out through the same payment method with which the purchase was made, that is, if the purchase was made by card, the amount to be refunded will be credited to the same card;
  • The data required for the return must be sent by the customer using the return form.
  • The customer will assume the cost and risk of returning the products, as indicated above.
  • All the products we display on our website are liable to vary slightly due to a change of presentation or small adjustments to the formulation. A slight period of time may pass between our receiving new batches of product and the information being updated on the website. In these cases in which the product has only changed in its external presentation or with minimal changes to its formulation, we cannot accept returns after the withdrawal period for that reason.

 

  1. Guarantee of conformity

Safivita S.L., as provider, guarantees the conformity of the products in accordance with Royal Legislative Decree 1/2007 (Spanish consolidated text of the General Law for the Defence of Consumers and Users) and will be liable for any lack of conformity that becomes apparent within a period of two years from delivery.

 

  1. Procedure for handling complaints

To notify us of any possible incident in the service or to consult us / make suggestions about whatever you wish, you can contact us at any time.

If you consider that the provider has breached any legal commitment or commitment agreed with you in writing, you have the right to file a complaint through the following means:

  1. Limitation of liability

The provider shall not be liable, under any circumstances, for direct or indirect damages arising from misconduct, improper use or negligence on the part of the buyer or third parties, nor for any other circumstance beyond the provider's reasonable control. The user and/or buyer is responsible for verifying that PLENIAGE® products are compatible with their needs, medical conditions or previous treatments.

 

In particular:

 

Safivita S.L. does not assume responsibility for health problems, adverse reactions or effects arising from the inappropriate use of the products, which the buyer or third-party consumers thereof may experience.

The provider's liability is strictly limited to the value of the product purchased in the event of a manufacturing defect or delivery failure directly attributable to the provider, excluding any other implied or explicit warranty that is not set out in these terms and conditions.

This limitation of liability does not affect the consumer's rights recognised by the applicable legislation nor the customer's rights under the legal guarantee of conformity.

 

  1. Applicable law and competent courts

These Terms and Conditions are governed by Spanish law, and all the conditions referred to herein, as well as any dispute or difference arising between the parties, are subject to the jurisdiction and competence of the Consumer Courts and Tribunals.

  1. About the European online dispute resolution platform

If you have a complaint, or you believe that we have not handled your complaint satisfactorily, please contact us at info@pleniage.com before submitting a complaint through the Online Dispute Resolution platform. At PLENIAGE we take customer service very seriously and adopt the highest standards when it comes to the management, response and resolution of our customers' concerns.

Nevertheless, if you ultimately consider that we have not dealt with any matter in conformity, we inform you that, for the resolution of consumer disputes (in accordance with art. 14.1 of Regulation (EU) 524/2013), the European Commission makes available to you an online dispute resolution platform which is available at the following link:
